Keith Tooley was co-counsel for a client who successfully prevailed in the leading Colorado Supreme Court case establishing the legal principle that oil and gas are included in a deed reservation of "other minerals".

Brian Tooley, Steve Bain, and Kathryn Haight recently settled a Colorado class action lawsuit against the firm’s client for alleged underpaid royalties. The over $10 million exposure was settled prior to class certification, through mediation, for payment of approximately $2.5 million and an agreed-upon settlement class.

Keith Tooley obtained a constructive trust for the Firm’s client over more than 200 sections of land in north central Montana, plus damages, after a lengthy trial to the court.

Brian Tooley and Steve Bain recently settled litigation in Wyoming on behalf of an operator involving a drilling contractor’s negligent destruction of a wellbore, and successfully settled a claim against the drilling contractor stemming from a stuck drilling pipe after losing mud circulation.

Brian Tooley obtained a partial summary judgment on the central issue in a complicated title and payout dispute involving substantial acreage in the San Juan Basin in Colorado, resulting in the successful settlement of the action.
